š¼ļø WHO OWNS YOUR AI-GENERATED PRODUCT IMAGES?
For Amazon sellers considering AI tools for product images, hereās what you need to know about rights and risks:
Copyright Basics
AI-Generated Images Lack Copyright: U.S. copyright law only protects works with human authorship. Therefore, any image created solely by AI isn't eligible for copyright, meaning you can't legally protect it or stop others from using it.
No Owner for AI Images: Since the AI itself isn't recognized as an "author," no one technically owns the exclusive rights to AI-generated content. This means your competitors or others could potentially use your AI-created images without permission.
Legal Implications
Limited Legal Recourse: If someone reproduces or distributes your AI-generated images, current laws donāt allow you to sue or enforce any take downs since you donāt hold exclusive rights.
Risks of Copyright Infringement: Using AI tools can introduce potential copyright issues, especially if the AI system was trained on copyrighted images without permission. This has led to lawsuits like Getty Images suing Stability AI over misuse of images.
Practical Considerations
Trust and Quality Concerns: AI content, though efficient, may face credibility issues. Competitors can easily replicate non-copyrighted, AI-generated visuals, potentially affecting brand uniqueness.
Fair Use and Derivative Works: To better protect your content, consider:
Transformative Uses: Adding significant, creative modifications may help qualify AI images for fair use and protection.
Human-Enhanced Content: Use AI for brainstorming, then make substantial edits or finalize the design yourself to strengthen its copyright eligibility.
Note for Amazon Sellers
While AI is an effective, time-saving tool, Amazon sellers should be cautious. Be mindful of the legal gray areas, as AI-generated images lack copyright protection. If exclusivity and brand integrity are critical, consider blending AI-generated concepts with original, human-created elements for added legal security.
š SELLER STATS YOU SHOULD KNOW
Chinese cities dominate Amazon seller network - more than half of Amazonās top 20 seller bases are in China.
Shenzhen, a technology and factory hub in Chinaās southern Guangdong province, leads the pack with 102,588 sellers registered on Amazon, collectively generating US$35.3 billion revenue annually.
In second place is Guangzhou, capital of Guangdong, followed by the shoemaking hub of Putian in southeastern Fujian province, and Dongguan, another Guangdong city.
The import and export value of Chinaās cross-border e-commerce industry reached 2.38 trillion yuan (US$333 billion) in 2023, up 15.6 per cent from the previous year, according to the State Council Information Office.
š TWO SIGNIFICANT SELLER LOGISTICS DEVELOPMENTS
For Amazon sellers, two significant developments have emerged that could impact their business strategies and operations:
Expansion of FBA Export Program
Amazon has substantially expanded its Fulfillment by Amazon (FBA) Export program, now reaching 136 new countries.
This expansion opens up vast new markets for sellers, potentially increasing their customer base and sales opportunities (not all products qualify).
The program now covers a total of 178 countries and regions.
Sellers can reach these new markets without additional fees or the need to change their business operations.
The expansion includes countries in Africa, the Caribbean, Central America, the Middle East, Oceania, South America, and Southeast Asia.
Benefits for Sellers:
Access to millions of new customers globally
No need for separate international logistics
Potential for increased sales and business growth
To exclude your products from FBA Export, log into Seller Central and click Fulfillment by Amazon in the āSettingsā drop-down menu. Go to the āFBA Exportā section as seen in the screenshot below. In the āExport Settingsā group, click āEditā to switch this to āDisabledā.
Changes in Inbound Fulfillment
Amazon has made significant changes to its inbound fulfillment process, which could affect sellers' inventory management and costs
The company has reduced the time it takes to receive inventory at fulfillment centers by 33% compared to the previous year.
Amazon is now processing 80% of its inbound volume within 24 hours of arrival at its facilities.
These improvements have led to faster inventory availability for sellers and reduced stockouts.
Impact on Sellers:
Faster inventory processing times
Potential for improved sales due to better stock availability
Possible reduction in storage costs and improved cash flow
These developments present both opportunities and challenges for Amazon sellers. The expanded FBA Export program offers access to new markets, while the improved inbound fulfillment process could lead to more efficient inventory management. Sellers should consider how to leverage these changes to optimize their Amazon business strategies.
Multiple sales channels. One world-class supply chain.

š¤š½ WILD ARBITRAGE HACK BETWEEN TEMU & AMAZON
Trung Phan on Linkedin recently posted this interesting tactic. Thereās a wild arbitrage hack going on between Amazon and Temu and itās costing some sellers big bucks.
It's working because a lot of Amazon merchants are from China or donāt differentiate their products enough. Temu is aggressively offering better terms (eg. less of a listing fee) to repost products under different name on its platform.
In some case very similar items, some which could be counterfeit, are also being returned to Amazon and getting full Amazon refunds.
Amazon doesnāt thoroughly check every return, so if it looks similar, itās refunded. So buyers are ordering on both platforms, getting it in a few days from Amazon, then when the cheaper Temu version shows up a couple weeks later they return to Amazon for a refund, thus saving a lot of money.
